POCA News: Samir Pasha assists in securing return of £20,000 cash seized
Samir’s client, a private hire driver who works as a chauffeur, had his appeal successfully upheld at Westminster Magistrates Court yesterday.
Samir’s client had his private hire licence revoked by Transport for London (TFL) following the endorsement of 6 points on his licence following a speeding offence. The decision to revoke his licence was made on the basis that any single offence which entails 6 points or more constitutes a major driving offence, which means the licence is revokable. A further reason given by TFL was that the client did not notify TFL of his endorsement of points within 21 days as stipulated in the TFL’s Driver Policy.
If TFL determines that a licensed private hire vehicle driver is no longer fit to be licensed or any other obligation imposed on them by the legislation, TFL may suspend or revoke their licence.
The appeal focused on showing that Samir’s client was fit and proper despite the basis of revocation from the TFL.
After a one-hour hearing, the bench determined that Samir’s client was fit and proper, considering his otherwise impeccable driving record, his exemplary driving record, and no records of poor safety or complaints.
The client was elated after the hearing as he was so nervous beforehand due to the fact that driving was his sole income to support his family.
