Another Successful Reinstatement of Sponsor Licence
Samir’s client was charge with six counts on the indictment, containing 4 charges of possession with intention to supply class A + B, possession of prohibited weapon, and possession of criminal property.
The Class B drugs supply charge was based on approximately 4kg of cannabis recovered from the client and her partner’s home, valued at over £32,000. The charges also included supplying psilocin, also known as ‘magic mushrooms’, comprising of 194 capsules recovered from the client’s bedroom. The charges further included possession of a CS pepper spray and over £6,500 cash.
The prosecution evidence relied on police observations and phone downloads of messages, also including bags of cannabis imported from the USA.
Strategic review of the evidence by Samir and representations made by him with the Crown resulted in the client pleading guilty to one count of possession with intention to supply class B, on a basis that she was made to help in the enterprise by her partner who was abusive towards her. Furthermore, the Crown agreed not to proceed against the client on the remaining 5 counts on the Indictment.
In mitigation, the client’s defence team obtained psychiatric and psychological reports which described the numerous mental and psychological issues the client was labouring under as a victim of child sexual abuse and domestic violence at the hands of her co-defendant. At Aylesbury Crown Court, the sentencing judge accepted submissions that the client’s position reflected a Lesser Role in the sentencing guidelines, and was sentenced to a Community Order in contrast to the co-defendant who was sentenced to 29 months’ imprisonment.
