3 successful outcome following drafting of JR grounds

The first (LK -v- SSHD) was against a decision certifying asylum claim as unfounded for a mother with 3 dependent children. Despite the mother being vulnerable and one of the children having medical grounds, the SSHD saw fit to refuse and certify her claim as unfounded. Due to her vulnerability, the client did not seek legal representation until after the 3-month window period. Thilaga drafted grounds challenging the decision to be accepted in time and also against the irrational decision certifying the claim. The SSHD not only conceded but proceeded to review the decision and granted mother and children with refugee status!

The second (AK -v- SSHD) and third (FK -v- SSHD) judicial reviews challenged against NRM negative reasonable grounds decisions. Thilaga successfully drafted grounds challenging both decisions that it lacked care on consideration of facts and procedurally unlawful therefore severely prejudicing the clients. Both JR has been conceded with one resulting in finding of positive reasonable grounds and the other for review.

All 3 concluded with successful cost recovered from SSHD.
