Immigration News: Another Successful Reinstatement of Sponsor Licence

We are pleased to confirm the successful reinstatement of a Pre-School sponsor licence following suspension by the Home Office Sponsor Compliance Team.

After a compliance visit, the Home Office raised multiple concerns regarding sponsor duties, including:

  • Alleged underpayment in relation to the applicable Skilled Worker salary threshold
  • Reliance on an Occupational English Test not listed as an approved SELT provider
  • Omission of requested job description documents during the compliance process
  • Delayed online Right to Work checks
  • Inconsistencies in maintaining up-to-date sponsored worker contact details
  • Incomplete recruitment record evidence (advertisement metadata and closing dates)
  • Delays in reporting changes to sponsored workers’ start dates and visa outcomes on the Sponsorship Management System (SMS)

Thilaga Srindran was instructed to draft representation against suspension.

Following a conference and a carefully structured representations addressing each allegation, the Home Office accepted the representations in full and confirmed that all concerns had been satisfactorily addressed. As a result, the sponsor licence was reinstated with immediate effect.

This case demonstrates the importance of precise legal analysis, careful evidence collation, and proactive compliance rectification when responding to sponsor licence suspensions.

Thilaga has provided valuable assistance to numerous employers facing similar situations.
