Crime News: Suspended sentence for client pleading guilty to perverting course of justice

Samir Pasha’s client was initially charged with 2 counts of Perverting the Course of Justice, in relation to s172 Notices not completed accurately. The client was a taxi driver who was looking at a serious custodial sentence as a result of the charges on indictment.

Samir first managed to persuade the Crown to agree to proceed one only 1 count of Perverting the Course of Justice at the PTPH stage.

The sentencing judge made it clear that this was a serious offence and the sentencing guidelines also reflected the seriousness with custodial sentence being the bulk of the guidelines.

At Luton Crown Court today, Samir put forward strong mitigation including making representations on the culpability guidelines, where the Crown were putting at High Culpability, Samir put forward there were elements of Low Culpability and therefore it should be Medium Culpability, which was in the end accepted by the sentencing judge. The client was eventually given a 30-week prison sentence suspended for 18 months, with a 100-hour unpaid work requirement and costs of £100.
