Crime News: Samir Pasha’s client given suspended sentence in private fraud prosecution by the DVSA

Samir’s client was charged with 2 counts of fraud, under s7 Fraud Act 2006, related to providing a provisional driving licence to someone else to take a driving theory test. The test did not proceed as the licence was found to be adapted with someone else’s photograph on the licence card.

In a private prosecution brought by the DVSA the client plead guilty at the 1st Appearance at City of London Magistrates Court. The court was informed that these offences should be placed in the highest category of the Sentencing Guidelines, with a starting point of 4 years 6 months’ custodial sentence. The prosecution also provided case law to support their sentencing submissions that a custodial sentence ought to be imposed.

Representing the client at Westminster Magistrates Court, Samir made detailed submissions addressing the seriousness of the offences in accordance with the sentencing guidelines and also challenged the costs application by the DVSA of over £4,000.

The Court in sentencing imposed an 8-month prison sentence suspended for 2 years, with 8 days of Rehabilitation Activity Requirement, and also reduced the prosecution costs overall.
