Samir Pasha’s client was charged with sexually assaulting his 4-year-old daughter by sexual touching.
Allegations were made by the mother and after a full trial and almost 2 days of jury deliberation the jury returned a verdict of Not Guilty.
This case involved allegations made by the mother when the police arrived at the home of the family in January this year. The allegations related to supposed sexual touching having occurred in bed under a blanket.
The trial at Harrow Crown Court heard evidence from the mother who was the main Crown witness and a police officer who attended the scene. The Crown also relied on body worn footage of the initial report of the incident to the police. Samir’s client also gave evidence in court, and maintained that he was simply changing his daughter’s clothing.
This case involved careful navigating through the course of the proceedings, before and during trial, including considering a number of Crown applications to the Court. Samir provided tactical advice and guidance to ensure the issues for trial were narrow and focused as possible, with the evidence being robustly challenged during trial.
